What’s happening?
Gov. Wes Moore signed “safe harbor” legislation last Tuesday that will prevent child victims of human and sex trafficking from facing charges for several crimes they may have been coerced into starting Oct. 1, Matt Bush reports for WYPR. Maryland joins 40 other states in passing similar legislation.
What crimes are included in the legislation?
Under the new law, child victims can’t be prosecuted for a slate of crimes, including several related to prostitution, loitering, indecent exposure, and possession of controlled substances like drugs or alcohol. The law also protects child victims from being charged with fourth-degree burglary, trespassing, misdemeanor theft, destruction of property, use of a fraudulent government document, and driving without a license or with an expired license, among other vehicle-related crimes.
“Criminal records can ruin their entire lives,” said Montgomery County Senator Jeff Waldstreicher, one of the sponsors of the state senate bill. “Preventing them from getting the education they need, they deserve, the housing they need, or the services that will help them get out of the cycle of human trafficking.”

Between June 2013 and April 2020, there were 671 reports of suspected child trafficking screened by Child Protective Services units in Maryland, according to a study by the University of Maryland SAFE Center for Human Trafficking Survivors. The study also found that from 2010 to 2020, 110 youths were arrested in Maryland for prostitution and commercialized vice, including 33 arrests involving children ages 15 or younger.
