Six years after a robbery in which he was found not guilty, Keith Davis Jr. remains in prison as prosecutors try to convict him—for the fifth time—for a murder in Baltimore City that happened five hours before the robbery took place.
How can the Baltimore City State’s Attorney’s Office try him so many times for the same murder?
Even though Davis was tried multiple times, he was never acquitted. “If there is a manifest necessity for the declaration of a mistrial, the defendant may be retried without violation of the prohibition on double jeopardy,” according to Campaign Zero.

Throughout the saga, Keith’s wife, Kelly Davis, has emerged as “the public face of police and prosecutor accountability in the city,” according to Baltimore Magazine. The couples’ supporters are known as “Team Keith.” Among other national attention, they are backed by Baltimore native and activist DeRay Mckesson, founder of Campaign Zero, who launched a website that he says highlights more than 200 “contradictions, problems, falsehoods, and errors over Davis’ five trials.”
